The NPICC under the guidelines of the 1987 CONSTITUTION Article 6 section 1&32 r.a.6735 Comelec Resolution No.2300.R.A 7160 heading up the 10 Million plus Filipinos to Address the transition of government system to a better Constitution.

From 2019 will start a marathon move to deliver the plan for a BRANDNEW SYSTEM to uplift the lives of every FILIPINO with the PEOPLE’S INITIATIVE SYSTEM in aid of every government system administration both the National and Local government to modeled the entire nation for a fresh, different perspective, unique and fundamental challenge of the whole country.

THREE WAYS IN AMENDING THE CONSTITUTION ARTICLE XVII

1.Con-Con = Constitutional Convention, or constituents to elect representatives from the different districts called DELEGATES to give authority to proposed and draft amendments to the constitution.

QUESTION: Is this favorable considering the process of election today WHICH FRAUD AND BRIBERY IS IMMINENT?

THE ANSWER IS NO.....

2. CON-AS- Constitutional Assembly – by a 2/3 votes of the congress through a bi-cameral assembly of the congress to draft and amend the constitution.

QUESTION? Are these choices may favor both houses?

The answer is NO, because even the congress may have a unanimous vote on their draft amendment if the Senate veto the proposal it cannot prosper.

3 SYSTEMS OF INITIATIVE

1.  INITIATIVE on the Constitution which refers to a petition proposing amendments to the Constitution. (includes national legislation and local legislation).

2. INDIRECT INITIATIVE- is exercise of initiative by the people through a proposition sent to congress or the local executive body.

3. REFERENDUM- is the power of the electorate to approve or reject legislation through an election called for the purpose through an election called for its purpose. (national and local).

PROBLEM NO. 1 CORRUPTION

A.Massive corruptions resulted to the following;

a. Poverty affects food security.(gutom)
b. Insufficient support to food producers are not given the right and enough support to farmers, fishermen, workers.(hindi sapat na suporta sa manggagawa,hindi maayos ang daloy ng ekonomiya kung mismong mga manggagawa ay ginugutom)
c. Palaging pagtataas ng mga tarifa na naglalagay ng kabigatan sa mamamayan.

THE CONGRESS SHALL, AS EARLY AS POSSIBLE, PROVIDE FOR A SYSTEM OF INITIATIVE AND REFERENDUM, AND THE EXCEPTIONS THEREFROM, WHEREBY THE PEOPLE CAN DIRECTLY PROPOSED AND ENACT LAWS OR APPROVE OR REJECT ANY ACT OR LAW OR PART THEREOF PASSED BY THE CONGRESS OR LOCAL LEGISLATIVE BODY AFTER THE REGISTRATION OF A PETITION THEREFOR SIGNED BY AT LEAST 10 PERCENTUM OF THE REGISTERED VOTERS, OF WHICH EVERY LEGISLATIVE DISTRICT MUST BE REPRESENTED BY AT LEAST 3 PERCENTUM OF THE REGISTERED VOTERS THEREOF.

ARTICLE XVII SECTION 1-2

SECTION 1- ANY AMENDMENT TO , OR REVISION OF, THIS CONSTITUTION MAY BE PROPOSED BY:

(1) THE CONGRESS, UPON A VOTE OF THREE FOURTHS OF ALL ITS MEMBERS, OR

(2) A CONSTITUTIONAL CONVENTION

SECTION 2- AMENDMENTS TO THIS CONSTITUTION MAY LIKEWISE BE DIRECTLY PROPOSED BY THE PEOPLE THROUGH INITIATIVE UPON A PETITION OF AT LEAST TWELVE PERCENTUM OF THE TOTAL NUMBER OF REGISTERED VOTERS, OF WHICH EVERY LEGISLATIVE DISTRICT MUST BE REPRESENTED BY AT LEST THREE PERCENTUM OF THE REGISTERED VOTERS THEREIN. NO AMENDMENT OF THIS SECTION SHALL BE AUTHORIZED WITHIN FIVE YEARS FOLLOWING THE RATIFICATION OF THIS CONSTITUTION NOR OFTENER THAN ONCE EVERY FIVE YEARS THEREAFTER.

WHAT IS PEOPLE’S INITIATIVE?
1. PI- Is a common appellative in the Philippines that refers to either a mode for constitutional amendment provided by the 1987 Constitution.
2. PEOPLE’S INITIATIVE-is a way to make laws.
3. PEOPLE’S INITIATIVE is an exercise of power of the people to enact laws beyond the power vested in Congress provided for by the 1987 Constitution.
4. It is further defined in Republic Act 6735, which state that initiative is “ POWER OF THE PEOPLE” to proposed amendments to the constitution or to proposed and enact legislation through and election called for a purpose.


THE LAW ALSO STATES THAT THERE ARE 3 SYSTEMS OF INITIATIVE

1. INITIATIVE OF THE CONSTITUTION-which allows for a petition proposing amendments to the constitution.
2. INITIATIVE ON STATUTES-which allows proposals for enactment of a national legislation which covers ordinances and resolutions in the regional down to the barangay level .
3. INITIATIVE ON LOCAL LEGISLATION- which covers ordinances and resolutions in the regional which covers down to barangay level.

FOR NATIONAL LEGISLATIONS, atleast 10% of the total registered voters in the Philippines should sign the petition for a new law. It also requires the signature of at least 3% of the registered voters in each legislative district.

CHAPTER I THE PEOPLE’S LAW

SECTION 1. This Act shall be known as the PEOPLE’S INITIATIVE ACT of 2023
SECTION 2. Declaration of People’s Act and Policies

This Act shall address the following issues and policies that undermine the 1987 Constitution as the Philippines is a sovereign, democratic and a republican state:


CHAPTER II ADDRESS AND REGULATES EXTERNAL AND INTERNAL ISSUES

SECTION 1. The right and authority to intervene on the Pandemic Treaty, WEF-World Economic Forum, WHO-World Health Organization, International Criminal Court, Smartmatic, EDCA (ENHANCE DEFENSE COOPERATION AGREEMENT).

SECTION 2. INTERNAL AFFAIRS ISSUE

a. The right and authority to intervene on issues of Confidential Funds, land grabbing of ancestral domains and affecting Tribal rights, (RA 8371), massive graft and corruption, dangerous drugs, unconstitutional bills, ignorance RA 7160 (LOCAL GOVERNMENT CODE on Barangay Assembly) Public Servants and Employees Violation of RA 6713 AND R.A. 11032 ANTI-RED TAPE LAW) multiple violations of the 1987 CONSTITUTION, ignorance of the TRIPOLI AGREEMENT FOR Mindanao.

b. The people convened a PEOPLE’S CONGRESS enacted November 28, 2023 at the LIWASANG BONIFACIO can now proposed a new system of government appoint new sets of leadership and a constitutional forum and conduct public consultations.

c. The AUTHORITY and power of our elected officials are merely DELEGATED authority and power coming from the people and if the people can DELEGATE authority and the people can also RECALL the AUTHORITY AND POWER and the can directly exercise its authority.

d. As our Constitution is superior to our legislatures, so the PEOPLE are superior to implement our constitution when authorities fails, Indeed the superiority, in the last instance, is much greater, for the PEOPLE possess and protect the sanctity of our constitution, control in act, as well as right. At the local level, the Local Government Code (RA 7160) IS SUPERIOR TO THE LOCAL GOVERNMENT UNITS. BUT THE PEOPLE IS SUPERIOR TO THE LOCAL GOVERNMENT CODE and the PEOPLE can amend or change it through the system of “PEOPLE’S INITIATIVE” pass to the Congress. Through this, the PEOPLE CAN DIRECTLY LEGISLATE LOCAL LAWS AND ORDINANCES.

CHAPTER III DECLARATION OF PEOPLE’S AUTHORITY
SECTION 1. This act provides the People’s Initiative to constitute authority and responsibility at all times provided under the guidelines of the law and Constitution. (R.A 6735)

a. People’s Initiative can act without protocols or courtesies when the time is right to do so as former President Duterte says
"IF THERE IS A PEOPLE'S INITIATIVE TO EXIST FOR THE GENERAL WELFARE OF OUR COUNTRY I AM NOT CONTRADICT TO IT UNLESS MAY LEAD TO SEDITION OR REBELLION AGAINST THE GOVERNMENT."


Article II Section I 1987 Constitution.
The Philippines is a democratic and a republican state, sovereignty resides in the people and all government authorities emanates from them.
a. SOVEREIGNTY as the “THE SUPREME, ABSOLUTE, AND UNCONTROLLABLE POWER” by which any independent state is governed it is likewise the PARAMOUNT CONTROL” by which of the Constitution and frame of government and its administration.

b. Stated and say it again, THE PEOPLE IS SOVEREIGN AND SUPREME., The “people’ has the right to exercise above the Constitution, above Congress, above Senate, above all Courts and Supreme and even above the President of the Philippines when constitution is in direct crisis.

c. As our Philippine Constitution is superior to our legislatures, so the “PEOPLE” are superior to our Constitutions. Indeed, the superiority, in this last instance, is much greater; for the “PEOPLE’ possess over our Constitution, control in act, as well as right. The “PEOPLE” can form a PEOPLE’S CONGRESS, and the people can “DIRECTLY ACT” as a “PEOPLE’S CONGRESS.

CHAPTER IV RIGHT GOVERNANCE AND ADMINISTRATION

SECTION 1. The “PEOPLE “, wish to reiterate that in a democratic and republican state, only the PEOPLE are sovereign.

a. The sovereignty of the “PEOPLE” is indivisible. It is Not the elected President, not the elected Congress, not this un-elected Court. Indeed, the sovereignty cannot be reposed in any organ of government. Only its exercise can be delegated to any of them. In this case the PEOPLE delegated the PEOPLE’S CONGRESS the exercise of the sovereign power to amend or revise the Constitution and imposed foreign policies and intervention.

b. The PEOPLE does not lack this fraction of power to substantially amend the Constitution by DIRECT ACTION. When by then SOVEREIGNTY, ALL POWER EMANATES FROM THE PEOPLE by all means can make decisions both internal and external affairs.

CHAPTER V THE GENUINE PEOPLE’S INITIATIVE AUTHORITY TO DECLARE THE VALIDITY OF LAWS

Section 1.  The law provided for three kinds:
The PEOPLE can directly initiate constitutional amendments.
a. The People can directly pass NATIONAL LAWS.
b. The PEOPLE to directly initiate the passage of BARANGAY, MUNICIPAL, CITY, DISTRICT, PROVINCIAL, REGIONAL, NATIONAL ORDINANCES.
c. The PEOPLE CAN EXERCISE POWERS OF CONGRESS AND THE VARIOUS SANGUNIAN without the need to get elected as legislators.
d. The PEOPLE to initiate the passage of a NATIONAL LEGISLATION, the draft law must be signed must be pass to the CONGRESS and the PEOPLE’S CONGRESS determined by the signature petitions of its local representations.
e. Whether a commission is required to validate the number of signatures to be genuine, in this very crucial times there is none enough time to address but to use any possible and available source to support the qualification under the PEOPLE’S AUTHORITY AND MANDATE THAT THE GENUINE PEOPLE’S INITIATIVE ITSELF PROCLAIMS ITS GIVEN AUTHORITY DIVINELY AND WITH THE WISDOM OF AN ORGANIC WAYS AND MEANS THAT IS AVAILABLE TO IMPLEMENT. CHAPTER VIII THE IMPLEMENTING RULES, GUIDELINES AND ADMINISTRATIVE

SECTION 1. Authorized body to suspend or terminate.
The People themselves through the available organized body enacted by the GENUINE PEOPLE’S INITIATIVE “THE PEOPLE’S CONGRESS” administered by the appointed GENERAL COUNCIL.

a. With about 10 Million consolidated signatures all over the Philippines representing the more or less 110 Million presented as evidence to the Historical Event held at SUPREME COURT from MAY 4- JULY 7, 2022.

b. The PEOPLE can immediately act as the first instance authority.

c. The PEOPLE empower itself to act without any given permission provided under prescriptions of law bearing the absolute authority and might to act instantly and accordingly.

SECTION 3. The PEOPLE’S mandate to take the necessary action.

a. Mandated to take action above all existing of the land at all cost against all kinds of violation of law undermining SOVEREIGNTY, FREEDOM, the TRANSPARENCY and ACCOUNTABILITY, ready to suppress the traditional system towards a transitory government

SECTION 4. Date of effectivity. This Act shall take effect upon confirmation to all government instruments with 15 working days from today November 28,2023.

ARTICLE I

The Creation of a Federal and States Government 

SECTION 1.The Federal Government with one Prime Minister, Deputy Prime Minister(Vice Chancellor/First Vice Premier) cabinet members appointed or elected by the people, State Ministers/Sub-state Ministers/Associate Ministers, and Chief of Staffs, Parliamentary Secretaries (Assistant to the Minister)  elected or appointed by the people or its representation.

c. Ang pangatlong departamentong pang estado ay manggagaling sa representasyon ng mismong mamamayan mula sa bawat lokal o pangnasyonal na estado.

Obligasyon naman ng pangatlong departamentong pang-estado lokal o nasyonal na usigin, aralin ang bawat mungkahi bago ito ibalik sa unang departamentong pangestado bago ito pinal na ibigay sa tiga-pagimplemento ng mga programa,batas, o anumang mahahalagang usapin.

                                  THE FEDERAL AND STATE LAWS

SECTION 2

a. Anyone guilty of corruption proven intentional loss of any amount from one centavo(1 sentavo) and above will have the same extreme punishment of anyone spend 1,000,000 php of five years imprisonment without proper documents and cannot serve a second chance in any public office.

SECTION 2. FEDERAL STATE LAW ON ISSUANCE OF TRANSACTION RECEIPT.

a. The Federal government or State should not prioritize the hike of taxes instead lower it and regulate the legality of taxation by a compulsory issuance of official receipts to all commercial business entities. The seller and the buyer should take responsibility to secure and issue and failure of compliance should lead to severe punishment of not less than 3 years but not exceed to 5 years.

SECTION 3.FEDERAL STATE LAW ON TRANSPARENCY

a. All kinds of transactions from the highest branch down the least local office must be and should be 100% transparent to all constituents in the area covered using the advance information technology that all funds available, unliquidated, surplus, other budgets, tax, incomes of livelihood projects. This law prohibits secret transactions of government officials. If found guilty is punishable of imprisonment of not less than 5 years but not exceed to 10.

SECTION 4.

THE FEDERAL STATE LAW ON PROJECT GUIDELINE IMPLEMENTATION.

a. All kinds of projects infrastructures must be monitored and implemented by local estate unit where projects is located guided by an independent People’s Committee on Project Monitoring to ensure proper implementation. This law must strictly regulate the used of contractors and prohibit the use of firms owned by government estate officials and only People’s certified. Anyone proven guilty of violation of this law is punishable not lower than 5 years but not greater than 10 years.
