WHAT IS PEOPLE’S INITIATIVE?

1. OR PI- IS A COMMON APPELATIVE IN THE PHILIPPINES THAT REFERS TO EITHER A MODE FOR CONSTITUTIONAL AMMENDMENT PROVIDED BY THE 1987 CONSTITUTION

2. PEOPLE’S INITIATIVE IS A WAY TO MAKE LAWS

3. PEOPLE’S INITIATIVE IS AN EXERCISE OF POWER OF THE PEOPLE TO ENACT LAWS BEYOND THE POWER VESTED IN CONGRESS, PROVIDED FOR BY THE 1987 CONSTITUTION.

4. IT IS FURTHER DEFIND IN REPUBLIC ACT 6735, WHICH STATE THAT AN INITIATIVE IS “POWER OF THE PEOPLE TO PROPOSED AMMENDMENDS TO THE CONSTITUTION OR TO PROPOSE AND ENAC T LEGISLATIONS THROUGH AN ELEC TION CALLED FOR THE PURPOSE.

THE LAW ALSO STATES THAT THERE ARE 3 SYSTEMS OF INITIATIVE
1. INITIATIVE OF THE CONSTITUTION WHICH ALLOWS FOR A PETITION PROPOSING AMENDMENTS TO THE CONSTITUTION.
2. INITIATIVE ON STATUTES WHICH ALLOWS PROPOSALS FOR ENACTMENT OF A NATIONAL LEGISLATION
3. INITIATIVE ON LOCAL LEGISLATION WHICH COVERS ORDINANCES AND RESOLUTIONS IN THEV REGIONAL DOWN TO THE BARANGAY LEVEL.

FOR NATIONAL LEGISLATIONS, ATLEAST 10% OF THE TOTAL REGISTERED IN THE PHILIPPINES SHOULD SIGN THE PETITION FOR A NEW LAW. IT ALSO REQUIRES THE SIGNATURE OF AT LEAST 3% OF THE REGISTERED VOTERS IN EACH LEGISLATIVE DISTRICT.

CHAPTER I THE PEOPLE’S LAW

SECTION I. This Act shall be known us the PEOPLE’S INITIATIVE ACT of 2023

SECTION II. Declaration of People’s Act and Policies-
a. This Act shall terminate, disapproved, dissolved the following foreign and internal policies that undermine the 1987 Constitution as the Philippines is a sovereign, democratic and a republican state:

c. The people convened a PEOPLE’S CONGRESS enacted November 28, 2023 at the LIWASANG BONIFACIO can now declare a new government system and elect new sets of leadership when given duty and responsibility became futile legally persecuted by the people’s highest court the PEOPLE’S COURT OF JUSTICE.

d. The AUTHORITY and power of our elected officials are merely DELEGATED authority and power coming from the people and if the people can DELEGATE authority and power the people can also RECALL the AUTHORITY AND POWER and the PEOPLE CAN DIRECTLY exercise its authority and power.

e. As our Constitution is superior to our legislatures, so the PEOPLE are superior to our constitutions, Indeed the superiority, in the last instance, is much greater, for the PEOPLE possess over our Constitution, control in act, as well as right. At the local level, the Local Government Code (RA 7160) IS SUPERIOR TO THE LOCAL GOVERNMENT UNITS. BUT THE PEOPLE IS SUPERIOR TO THE LOCAL GOVERNMENT CODE and the PEOPLE can amend or change it through the system of “PEOPLE’S INITIATIVE” pass to the PEOPLE’S CONGRESS. Through this, the PEOPLE CAN DIRECTLY LEGISLATE LOCAL LAWS AND ORDINANCES.

CHAPTER III DECLARATION OF PEOPLE’S AUTHORITY

SECTION 1. This act provides the People’s Initiative to constitute authority and responsibility at all times provided under the guidelines of the law and Constitution. (R.A 6735)

b. People’s Initiative can act without protocols or courtesies to any branch as a co-parallel government.

c. SOVEREIGNTY as the “THE SUPREME, ABSOLUTE, AND UNCONTROLLABLE POWER” by which any independent state is governed it is likewise the PARAMOUNT CONTROL” by which of the Constitution and frame of government and its administration.

d. Stated and say it again, THE PEOPLE IS SOVEREIGN AND SUPREME., The “people’ has the right to exercise above the Constitution, above Congress, above Senate, above all Courts and Supreme and even above the President of the Philippines.

e. As our Philippine Constitution is superior to our legislatures, so the “PEOPLE” are superior to our Constitutions. Indeed, the superiority, in this last instance, is much greater; for the “PEOPLE’ possess over our Constitution, control in act, as well as right. The “PEOPLE” can form a PEOPLE’S CONGRESS, and the people can “DIRECTLY ACT” as a “PEOPLE’S CONGRESS.

CHAPTER IV RIGHT GOVERNANCE AND ADMINISTRATION

SECTION 1. The “PEOPLE “, wish to reiterate that in a democratic and republican state, only the PEOPLE are sovereign.

a. The sovereignty of the “PEOPLE” is indivisible. It is Not the elected President, not the elected Congress, not this unelected Court. Indeed, the sovereignty cannot be reposed in any organ of government. Only its exercise can be delegated to any of them. In this case the PEOPLE delegated the PEOPLE’S CONGRESS the exercise of the sovereign power to amend or revise the Constitution and imposed foreign policies and intervention.

b. The PEOPLE does not lack this fraction of power to substantially amend the Constitution by DIRECT ACTION. When by then SOVEREIGNTY, ALL POWER EMANATES FROM THE PEOPLE by all means can make decisions both internal and external affairs.

CHAPTER V THE GENUINE PEOPLE’S INITIATIVE AUTHORITY TO DECLARE THE VALIDITY OF LAWS

Section 1. The law provided for three kinds:

a. The PEOPLE can directly initiate constitutional amendments.

b. The People can directly pass NATIONAL LAWS.

c.. The PEOPLE to directly initiate the passage of BARANGAY, MUNICIPAL, CITY, DISTRICT, PROVINCIAL, REGIONAL, NATIONAL ORDINANCES.

d. The PEOPLE CAN EXERCISE POWERS OF CONGRESS AND THE VARIOUS SANGUNIAN without the need to get elected as legislators.

e. The PEOPLE to initiate the passage of a NATIONAL LEGISLATION, the draft law must be signed must be pass to the PEOPLE’S CONGRESS determined by the signature petitions of its local representations.

f. Whether a commission is required to validate the number of signatures to be genuine, in this very crucial times there is none enough time to address but to use any possible and available source to support the qualification under the PEOPLE’S AUTHORITY AND MANDATE THAT THE GENUINE PEOPLE’S INITIATIVE ITSELF PROCLAIMS ITS GIVEN AUTHORITY DIVINELY AND WITH THE WISDOM OF AN ORGANIC WAYS AND MEANS THAT IS AVAILABLE TO IMPLEMENT. SECTION 1. Authorized body to suspend or terminate.

The People themselves through the available organized body enacted by the GENUINE PEOPLE’S INITIATIVE “THE PEOPLE’S CONGRESS” administered by the appointed GENERAL COUNCIL.

b. With about 10 Million consolidated signatures all over the Philippines representing the more or less 110 Million presented as evidence to the Historical Event held at SUPREME COURT from MAY 4- JULY 7, 2022.

a. The PEOPLE can immediately act as the first instance authority before any order from THE PEOPLE’S COURT OF JUSTICE can suspend any threat to health, external or internal security protocol.

FUNCTIONS OF EACH DEPARTMENT

FIRST DEPARTMENT- THE RECENT ELECTED FROM PRESIDENT TO LGU
A. The elected officers of 2022 will not be remove as it is the mandate of our 1987 constitution, they will continue on their given time of service and function until such transition may be decided. They will also act as co founder of a the new constitution.

2. SECOND DEPARTMENT- THE NATIONAL PEOPLE’S INITIATIVE COUNCIL COMMITTEE
A. Serves as the representor of the PEOPLE’S ADMIN, from the National Admin and other agencies to the least LGU department.
B. Also serves as the independent consultancy of the Federal government.

3. THIRD DEPARTMENT – THE PEOPLE’S ADMINISTRATION
A. As illustrated in page no.7 the People’s Admin. department are non- member officers of any position from the first and second dept. They will serves as representative of the people designated in every LGU unit who took part in the decision and approving body,social, cultural,moral, Spiritual financial of every sitio, barangay, municipality, district, provincial gov. or even to the National government.

FUNCTIONS AND DESIGNATIONS OF SITIOCOM DEPARTMENT

SITIOCOM –SITIO COMMITTEE CHAIRMANSHIP

A. The SITIO-COMMITTEE CHAIR has its own office to the sitio composed of 3 major member committee, THE SITIOCOM, SITIO PEOPLE’S ADMIN. REPRESENTATIVE, and any MEMBER REPRESENTATIVE OF THE BARANGAY. Except the BARANGAY CAPTAIN, appointed by them in a given term to exercise.(EX. MONTHLY, QUARTERLY, ) plus an appointed 7 member committee and staff.

B. The SITIOCOM will be the one to feed information to the sitio community for plans and projects and the BARANGAY LFGU, AND BARANGAY PEOPLE’S ADMIN. REPRESENTATIVE should download plans and programs to the SITIOCOM. The SPAR take part in the decision making inside the SITIOCOM

2. THE BARCOM-BARANGAY COMMITTEE CHAIRMANSHIP

A. In the barangay level the BARCOM also has its own office administering the Sitcom officers in all sitio inside the barangay serves as assistant , independent body as to watchdog the right implementation of rules, laws governing rights and privileges, projects by the Barangay Council

B. It composed of 3 member head committee BARCOM, SITIO ADMIN. FEDERAL HEAD(CHOSEN AMONG THE SITCOM officers) and one representative from the MUNICIPAL LEVEL (from the council).

B. It composed of 3 member head committee BARCOM, SITIO ADMIN. FEDERAL HEAD(CHOSEN AMONG THE SITCOM officers) and one representative from the MUNICIPAL LEVEL (from the council) including 7 staff and admin officers.

PREAMBLE

SECTION 2. FEDERAL STATE LAW ON ANTI GRAFT AND CORRUPTION.

a. Anyone guilty of corruption proven intentional loss of any amount from one centavo and above will have the same extreme punishment and cannot serve a second chance in any public office.

SECTION 3. FEDERAL STATE LAW ON ISSUANCE OF TRANSACTION RECEIPT.

a.The Federal State should not prioritize the hike of taxes instead lower it and regulate the legality of taxation by a compulsory issuance of official receipts to all commercial business entities. The seller and the buyer should take responsibility to secure and issue and failure of compliance should lead to severe punishment of not less than 3 years but not exceed to 5 years.

SECTION 4.FEDERAL STATE LAW ON TRANSPARENCY

a. All kinds of transactions from the highest branch down the least local office must be and should be 100% transparent to all constituents in the area covered using the advance information technology that all funds available, unliquidated, surplus, other budgets, tax, incomes of livelihood projects. This law prohibits secret transactions of government officials.

Lahat ng klase ng transaksyon mula sa pinakamataas na departamento ng gobyerno pababa ay dapat 100% na bukas sa kaalaman ng ating mga kababayan sa bawat lokalidad, sa pamamagitan ng teknolohiya na lahat ng pundo ng gobyerno na meron kasalukuyan, nagamit na, hindi pa nagagamit, taxes o buwis.

SECTION 5. THE FEDERAL STATE LAW ON PROJECT GUIDELINE IMPLEMENTATION.

a. All kinds of projects infrastructures must be monitored and implemented by local unit or the barangay itself where projects is located guided by an independent committee to ensure proper implementation. This law must regulate the used of contractors and prohibit the use of firms owned by government officials.
